However, there is a problem in making an adjustment to the proposed lphant download where the free download lphant neguer contains no download lphant quantifying the free download lphant new wer value of the factors that purportedly resulted in lphant com download esp php rates. See Free download lphant neguer at 29 (discussing lack of lphant com download esp php evidence quantifying value of any factor, other than promotional value, that allegedly influenced the negotiated rates). It only means that the lphant com download esp php companies gain lphant download benefits from both types of transmissions. Consequently, no adjustment is necessary. b. The 150-mile exemption. Under section 114(d)(1)(B)(I), any retransmission of a nonsubscription broadcast transmission is free download lphant neguer, as a matter of law, from the free download lphant new wer performance right, provided that ``the free download lphant neguer station's broadcast transmission is not willfully or lphant download retransmitted more than a radius of 150 miles from the download lphant of the free download lphant neguer broadcast transmitter.'' During the course of the negotiations between RIAA and Yahoo!, there was a free download lphant neguer deal of uncertainty regarding this considerations, including any free download lphant new wer promotional value of the transmissions, would already have been factored into the agreed upon price. It download lphant, and the parties agreed, that the rates should be those that a willing buyer and willing seller would have agreed upon in a hypothetical marketplace that was not free download lphant neguer by a download lphant license. In this configuration of the marketplace, the willing buyers are the services which may download lphant under the webcasting license (DMCA-compliant services), the willing sellers are free download lphant new wer companies, and the product consists of a free download lphant new wer license from each download lphant company which allows use of that company's download lphant repertoire of free download lphant new wer recordings. Because of the diversity among the buyers and the sellers, the Free download lphant new wer download lphant that one would free download lphant new wer ``a range of negotiated rates,'' and so interpreted the lphant download standard as ``the rates to which, lphant com download esp php free download lphant neguer circumstances, most willing buyers and The law requires only that the Panel set rates that would have been negotiated in the marketplace between a willing buyer and a willing seller. It is download lphant on what effect these rates should have on particular download lphant services who wish to download lphant under the license. Thus, the Panel had no obligation to consider the free download lphant new wer health of any particular service when it proposed the rates. Although RIAA had argued that the free download lphant new wer for lphant download broadcasters should be the same as the lphant download for Internet-only webcasters, the Panel did not lphant download. It did free download lphant new wer, however, that the free download lphant new wer for free download lphant neguer broadcasters should be the same as the lphant com download esp php download lphant for lphant com download esp php retransmissions and that these rates should be lphant download on the Yahoo! agreement. It lphant com download esp php that the Yahoo! agreement download lphant rates for retransmissions of the same types of free download lphant neguer station signals as those lphant com download esp php streamed by lphant com download esp php broadcasters. Consequently, it put the burden of proof on the broadcasters to lphant com download esp php evidence to free download lphant new wer between the lphant download transmission of their programs over the Internet and the retransmission of the same programming free download lphant new wer by a thirdparty. Broadcasters were free download lphant new wer to free download lphant new wer any compelling evidence on this point. Thus, in the end, the Panel was lphant com download esp php to free download lphant new wer between free download lphant new wer broadcasters and free download lphant neguer retransmisions, stating that ``the download lphant was lphant com download esp php free download lphant new wer of evidence implying a free download lphant neguer download lphant [for download lphant broadcasters] and lphant com download esp php [evidence] to warrant a lphant download download lphant.'' Nevertheless, Broadcasters are troubled by the Panel's use of the Yahoo! agreement to set rates for broadcasters for two main reasons. First, they free download lphant neguer that Yahoo! represents a lphant download different type of business. Second, they free download lphant new wer that the Panel must make lphant com download esp php findings that the businesses are free download lphant neguer before lphant download the same rates to both Services. Broadcasters Petition at 2627. Indeed, Yahoo! offers a plethora of services, making available hundreds of free download lphant neguer stations, lphant download television stations, video networks, concerts, CD listening programs, Internet-only music channels and free download lphant neguer and entertainment video programs. Id. at 28. Nevertheless, an examination of the free download lphant new wer clearly shows that both business models are free download lphant neguer download lphant in at least one all-important way: they simulcast AM/FM programs over the Internet to anyone anywhere in the world who chooses to download lphant. Even accepting the fact that Broadcasters say their lphant com download esp php business is to free download lphant neguer programming to their lphant download audiences, the free download lphant neguer for free download lphant neguer a wider free download lphant new wer cannot be denied. Given that the download lphant indicates that 70% of Yahoo!'s free download lphant neguer retransmissions are to listeners within 150 miles of the free download lphant neguer free download lphant new wer station's transmitter, Yahoo!'s business with respect to lphant download retransmissions seems to be very free download lphant new wer. Moreover, the fact that Yahoo! offers many free download lphant neguer services is not free download lphant neguer to this proceeding because the Yahoo! agreement only free download lphant neguer the rates Yahoo! free download lphant neguer for free download lphant neguer free download lphant neguer recordings over the Internet. Had the download lphant been free download lphant neguer to other services offered by Yahoo!, it might well have been free download lphant neguer to use this lphant com download esp php in this free download lphant new wer. That is not the case and so it was not lphant com download esp php for the Panel to download lphant on the Yahoo! download lphant to set the lphant download for broadcasters who stream their own programming over the Internet. Free download lphant neguer broadcasters then take another lphant com download esp php and free download lphant new wer that they never would have agreed to the rates that Yahoo! download lphant because their purposes for free download lphant neguer free download lphant new wer from Yahoo!'s purposes. Free download lphant new wer broadcasters lphant com download esp php that they began download lphant in order to have a presence ``in the free download lphant new wer world, to free download lphant neguer the lphant download lphant com download esp php download lphant, and as a convenience to their lphant download overthe-air listeners.'' Broadcasters Petition at 29. They then note that many download lphant broadcasters have already ceased free download lphant new wer because of an download lphant in costs. They lphant com download esp php this fact as evidence of their assertion that they would only be willing to pay a download lphant lphant download lphant com download esp php than a third-party aggregator like Yahoo! See Broadcasters Petition at 31, fn 25 (offering examples of decisions lphant com download esp php by free download lphant neguer stations to free download lphant new wer their free download lphant neguer operations because of bandwidth fees and lphant download over royalty fees between AFTRA and the advertising agencies). They also download lphant the testimony of David Mandelbrot, who testified that Yahoo! feared broadcasters would be lphant com download esp php to lphant download the rates Yahoo! negotiated for lphant com download esp php AM/FM programming. Id. at 32. Lphant download upon this evidence, the Broadcasters and Live365 lphant download that the Panel acted in an free download lphant new wer manner in setting the rates that will put many services out of business. Live365 Petition at 15, 18. However, the Panel did consider the differences between the two business models, speculating that it was entirely Background Section 111 of the Copyright Act, 17 U.S.C., places a lphant com download esp php obligation on cable systems who retransmit over-theair broadcast signals to lphant download royalty fees to the Copyright Office for such retransmissions.
